MB Homes – Terms & Conditions

1. Introduction
Welcome to MB Homes Team (“we”, “our”, “us”), a real estate team led by licensed sales representatives Manuel and Ana Bustamante, operating under the legal entity 1000002825 Ontario Inc. and affiliated with Century 21. While MB Homes Team is an independent brand, its team members are officially registered real estate sales representatives with Century 21.
By using our real estate services, website, or communication tools (“Services”), you (“Client”, “User”, “Buyer”, or “Seller”) agree to these Terms & Conditions. If you do not agree, please do not use our services.
Our services are delivered through MBhomesteam.com, and our team communicates using century21.ca email addresses as part of our professional affiliation with the Century 21 brokerage. This relationship is clearly disclosed to ensure transparency and compliance with Canadian real estate and communication standards.
2. Definitions
MB Homes Team: The brokerage and its licensed real estate agents operating under the MB Homes Team brand.
Client: Individuals or businesses using MB Homes Team services to buy, sell, lease, or manage real estate.
Property: Real estate listed, marketed, or transacted through MB Homes Team.
MLS: Multiple Listing Service used to publish and syndicate listings.
3. Services Provided
MB Homes provides licensed real estate brokerage services, including but not limited to:
Property listing, marketing, and syndication via MLS and partner platforms
Buyer representation and agency services
Property tours, open houses, and showing coordination
Negotiation and preparation of offers, agreements, and counter-offers
Market analysis, valuations, and investment guidance
Referral to mortgage, legal, inspection, or related professionals
4. User Responsibilities
By using our services, you agree to:
Provide accurate and truthful information during consultations, listing preparation, or buyer qualification processes.
Comply with all applicable laws including Canadian Real Estate Association (CREA) standards, Real Estate Council of Ontario (RECO) regulations, and relevant provincial consumer protection laws.
Respect viewing schedules, showing etiquette, and property access guidelines.
Maintain confidentiality of any login credentials provided for client portals or document access.
5. Commission & Payment Terms
Commission rates are agreed upon in the listing or buyer representation agreement and are payable upon the successful closing of a transaction.
Unless otherwise agreed in writing, commissions are paid via the brokerage from closing funds held in trust.
Fees for additional services (e.g. staging, enhanced marketing, property management consulting) are invoiced separately if applicable and are due upon receipt.
6. Cancellation & Termination
Listing or buyer representation agreements may be terminated in accordance with the terms stated in the signed agreement and provincial real estate regulations.
MB Homes reserves the right to terminate service or representation if:

Fraudulent, illegal, or unethical activities are identified
Outstanding invoices remain unpaid without valid dispute or communication
7. Privacy, Data Protection & SMS Communications
MB Homes Team, operating under the legal entity 1000002825 Ontario Inc., is led by licensed real estate sales representatives affiliated with Century 21. We collect, store, and process personal information solely to provide real estate services, manage client relationships, and ensure compliance with relevant laws and industry regulations.
All client data is protected in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial laws. We implement appropriate safeguards to protect your information from unauthorized access, disclosure, or misuse.
Information may be shared with third parties only as necessary for delivering our services (e.g., MLS listings, legal documentation, mortgage professionals) or when required by law.
By submitting your phone number via our website, forms, or other channels, you consent to receive SMS/text messages related to:
Appointment reminders
Property updates and alerts
Showing schedules
Service notifications
Message frequency may vary depending on your activity with us. Standard message and data rates may apply. You may opt out of text messages at any time by replying “STOP,” or request help by replying “HELP.”
Your mobile number will never be sold or shared for unrelated third-party marketing.
Please note that while our website domain (mbhomesteam.com) and email addresses (e.g., [email protected]) do not share the same domain, they are both officially used in the delivery of our services. This arrangement reflects the professional affiliation of our team members with Century 21, as clearly indicated on our website and public marketing materials.
8. Intellectual Property
MB Homes branding, marketing materials, photography, videos, and listing descriptions remain its intellectual property.
You may not reuse, duplicate, or distribute these materials without written permission.
9. Limitations of Liability
MB Homes services are provided on an “as is” basis without warranties of any kind beyond statutory protections.
MB Homes is not liable for indirect, incidental, or consequential damages including missed opportunities or unrealized gains.
In no event shall MB Homes’ liability exceed the total commissions or fees received from the client in the preceding 12 months.
10. Governing Law
These Terms & Conditions are governed by the laws of Ontario, Canada, and applicable federal real estate and consumer protection laws.
11. Changes to Terms
We may update these Terms at any time. Material changes will be communicated via email or website notices. Continued use of services after such updates indicates your acceptance of the revised terms.
